The Waste Electrical and Electronic Equipment (WEEE) Regulations of 2013 were enacted in the UK on January 1, 2014, superseding the 2006 regulations. These regulations incorporate elements of the EU WEEE Directive into UK law, aiming to reduce the amount of electrical waste sent to landfills and making producers accountable for the disposal of the electrical products they sell.

As part of Extended Producer Responsibility (EPR),Ā  WEEE regulations take a unique approach compared to the reform of packaging regulations. This difference arises because Electrical and Electronic Equipment (EEE) is of higher value and is purchased less frequently by consumers, unlike packaging, which is bought more often.

Does WEEE compliance apply to you?

Your business is deemed a producer and falls under the WEEE Regulations if it is the first entity to introduce electrical and electronic equipment (EEE) to the UK market through importing, manufacturing, rebranding, or distance selling.

What does EEE mean?

According to the UK Government, EEE can be defined as equipment:

  • which is dependent on electric currents or electromagnetic fields to work properly
  • for generating, transferring and measuring these currents and fields
  • designed for use with a voltage rating 1,000 volts or less for alternating current and 1,500 volts or less for direct current

WEEE Categories

For each compliance year you must report products you put on the market in one of these 14 categories:

  1. Large household appliances
  2. Small household appliances
  3. IT and telecommunications equipment
  4. Consumer equipment
  5. Lighting equipment
  6. Electrical and electronic tools (with the exception of large-scale stationary industrial tools)
  7. Toys, leisure and sports equipment
  8. Medical devices (with the exception of all implanted and infected products)
  9. Monitoring and control equipment
  10. Automatic Dispensers
  11. Display Equipment
  12. Appliances containing refrigerants
  13. Gas Discharge Lamps and LED light sources
  14. PV panels (solar panels)

Electrical and Electronic Equipment (EEE)

Waste Electrical and Electronic Equipment (WEEE)

  • Definition: WEEE refers to EEE that has reached the end of its useful life and is considered waste. This includes discarded or obsolete electronic products and components.
  • Disposal and Recycling: WEEE must be handled, collected, and recycled properly to minimize its environmental impact. Improper disposal can lead to environmental pollution and health hazards due to the toxic substances that can be present in electronic waste.
  • Regulations: There are specific regulations, such as the WEEE Directive in the EU, that require producers to manage the collection, recycling, and recovery of WEEE. These regulations aim to ensure that electronic waste is disposed of responsibly and that valuable materials are recovered and reused.

Producers that place more than 5 tonnes of EEE onto the UK market (large producer) must:

  • register with a compliance scheme to fulfil their legal obligation
  • complete annual or quarterly submissions of your placed on market data for WEEE
  • ensure EEE is marked with the appropriate labelling requirements i.e crossed out wheelie bin symbol,Ā the actual date the EEE has gone onto the market and a producer identification mark e.g. brand
  • assess your WEEE distributor obligation and if required provide a way for your customers to dispose of their old household EEE

Your company will be assigned with a WEEE registration number when you become compliant with the WEEE regulations. The number will serve as proof of the registration of the manufacturer, the brand and type of electrical or electronic equipment carried out in the country of manufacture. Your company will also be placed on the public registry, along with which Compliance Scheme you are registered with.

If you place 5 tonnes or less on the UK market, you can register directly with the Environment Agency, however a large producer (placing over 5 tonnes) must register through a compliance scheme.
